Yes, it is transferred simultaneously if the app is open. The internal memory of the pen can also store part of the text for a short time without the app being open. The pen also recognises which page you are on.
The refill that does not write, does write, you just have to scrape off the "protective cap". Replacement refills are conventional D1 refills, if you Google them or ask in a stationery shop, they are easy to get. Like here, of course, almost everything has one: Caran d'Ache D1 refill RNX316 (replacement refill, blue, red, black, 0.50mm) Faber-Castell ballpoint refill D1 (replacement refill, black, 0.50mm)
The notebook is only available in black, looks a bit hard to get used to, but works fine. Takes some time to get used to!

It didn't work for me for ages either, except with the tablet. I then contacted Moleskine directly. They gave me a small but important hint to activate Bluethoot and the location on the mobile phone, and lo and behold, it then worked without problems to connect/register.
